PRIVACY POLICY AND INFORMATION ABOUT PROCESSING OF PERSONAL DATA ON MARCOVA WEBSITES

In it you will find the rules of processing your personal data and the use of cookies and other tracking technologies in connection with the use of Marcova websites. 1 Definitions
To make things clear, here are the most important terms:
• Personal Data - any information about an identified or identifiable natural person, including, but not limited to, data such as device IP address, location data, Internet ID, and information collected through cookies and similar technologies.
• Policy - this Privacy Policy.
• RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
• Services - websites operated by the Administrator, including marcova.pl, b2b.marcova.pl, emspot.pl, as well as Fanpages on social networks and Marcova accounts on trading platforms.
• User - an individual using the Website or its single functionality.
2 Who processes your personal data?
The administrator of your personal data is Marcova Biznes Sp. z o.o. (formerly Marcova Sp. z o.o. Sp. komandytowa) with its registered office in Warsaw, 30 Rozwadowska Street, NIP: 5242667621, KRS 0000940255, e-mail: rodo@marcova.pl.

4 Important information
We reserve the right to change this privacy policy. Changes may result from developments in Internet technology, possible changes in data protection law or legal requirements. We will inform you of any changes in a visible and understandable manner.
The following is the most important information about our policies regarding our processing of your personal data and our policies regarding cookies and Internet identifiers that are used within our Services or Fanpages on social networks. If our Services and social profiles contain links to third-party websites, please note that this policy does not apply to those sites. Read the privacy policies of those sites.
5 Where does Marcova obtain your data from?
We obtain your personal data in accordance with Articles 13 and 14 of the DPA. We usually collect them directly from you when you voluntarily provide them by visiting our Sites.
We may also obtain data from other sources, such as:
• Social networks: when you share your data with us through Facebook or LinkedIn social plugins or features (e.g. Facebook Ads).
• Trading platforms (marketplaces): e.g. Allegro, which, in order to complete transactions on these platforms, provide Marcova, as the seller, with your necessary data to perform the contract.
6 Purposes and periods of data processing
We process your data within the Services and platforms we use for the following purposes and for the periods indicated:
Your use of the Marcova Services and Online Stores:
• Content sharing and presentation: We process the necessary data (e.g., IP address, identifiers, cookie information) to share content on the Services. Legal basis: our legitimate interest (Article 6(1)(f) RODO).
• Conclusion and execution of contracts: We process your data in order to conclude and execute a purchase and sales agreement in our Online Stores (with or without Account registration), an agreement for the provision of Electronic Services (maintaining an Account, sending a Newsletter) or to take actions at your request before concluding the aforementioned agreements. Legal basis: concluded contract and activities aimed at its conclusion (Article 6(1)(b) RODO). Examples of activities are: initial assessment/completion of customer data, needs analysis, transfer of offer, administration of remuneration/order, monitoring of order execution, general administrative operations. When using Electronic Services, the regulations provided shall apply.
• Expressing opinions: We allow you to express your opinion about the concluded purchase/sale agreement in opinion portals. You then consent to the transfer of the necessary data identifying the transaction to such portal. Legal basis: your consent (Article 6(1)(a) RODO).
• Complaint handling: We process your data to handle complaints on the basis of contract performance (Article 6(1)(b) of the DPA), and in some cases on the basis of legal regulations (e.g., under warranty for complaints and withdrawal, Article 6(1)(c) of the DPA).
• Fulfillment of legal obligations: We process your data because we keep accounts. Legal basis: performance of our legal obligations (Article 6(1)(c) RODO).
• Investigating and defending against claims and ensuring accountability: We process data to investigate and defend against claims and to ensure accountability for the use of the Services. Legal basis: our legitimate interest (Article 6(1)(f) RODO). Online shopping on shopping platforms (e.g. Allegro): When using shopping platforms, the regulations made available on the platforms shall apply, specifying the terms of use and information on data processing by the operators of these portals. On the platform itself, we also indicate the relevant information obligation from Marcova, as a separate Controller to whom your data has been shared.
• Conclusion and execution of contracts: We process data for the purpose of entering into and executing a purchase and sale contract or taking action at your request prior to entering into such a contract with Marcova, as well as managing all aspects of the cooperation through the trading platforms. Legal basis: the concluded contract and actions to conclude the contract (Article 6(1)(b) RODO).
• Complaint handling: We process your data to handle complaints based on the performance of the contract (Article 6(1)(b) of the RODO), and in some cases based on the law (e.g., under warranty, Article 6(1)(c) of the RODO).
• Fulfillment of legal obligations: We process your data because we keep accounts. Legal basis: fulfillment of our legal obligations (Article 6(1)(c) RODO).
• Investigating and defending against claims and ensuring accountability: We process data to investigate and defend against claims and ensure accountability of our actions. Legal basis: our legitimate interest (Article 6(1)(f) RODO).
• Direct marketing (when you are our customer): We process data for direct marketing purposes in connection with the commercial activities of Marcova when you have become our customer (e.g. finalized a transaction). Legal basis: our legitimate interest (Article 6(1)(f) RODO). • Direct marketing (when we establish a relationship): We process data for direct marketing purposes when we are just establishing a relationship (e.g., you want to buy goods or services). Legal basis: your consent (Article 6(1)(a) RODO). Important! If we want to share your data with our business partners so that they can send you marketing communications, we will always ask you first. We do not sell your data to other companies. You also have a choice of communication channel, which is your consent to receive commercial/marketing information/event promotions, etc. to the email address provided, by phone or SMS.
• Analytical and statistical purposes: we process data for analytical and statistical purposes, conducting analysis of shopper activity and preferences (including detection of abuse and violation of rules and regulations) and to improve functionality. Legal basis: our legitimate interest (Article 6(1)(f) RODO).
• Archival purposes and system security: We process data for archival purposes and to maintain the business continuity and security of our IT systems. Legal basis: our legitimate interest (Article 6(1)(f) RODO). Social networks:
• Interaction and promotional purposes: You share your data with us on social networks by interacting with us (chat, comments, fanpage, Like, Share buttons) and promoting our events, products or services. In doing so, we fulfill the promotional and communication objectives of our brand. Legal basis: our legitimate interest (Article 6(1)(f) RODO). If you use contact forms or instant messaging on these portals, the information in the section "Contact forms and email contact with Marcova" also applies. Remember: We have limited influence over the statistics shared by Facebook or LinkedIn and can only prevent their transmission to a limited extent. We strive to ensure that additional optional statistics are not shared with us. Facebook or LinkedIn may use your profile data or online behavior data to analyze your preferences, personal contacts, interests, etc. Marcova has no control over the processing or transfer of your data by these portals.
A. Co-management of data with Facebook Ireland Limited
1. Marcova and Facebook Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) are joint controllers of your data in accordance with Article 26 of the DPA for the processing of data for statistical and advertising purposes.
2. The joint controllers include aggregate data analysis for the purpose of displaying statistics on the activity of the Administrator's Fanpage users.
3. Facebook Ireland Limited's responsibilities:
o To have a legal basis for the processing of data for site statistics.
o Ensuring that the rights of data subjects are realized.
o Reporting violations to the supervisory authority and notifying affected individuals.
o Ensuring appropriate technical and organizational measures to ensure the security of your data.
4. Marcova's responsibilities:
o Having a legal basis for processing data for statistical purposes.
o Fulfillment of information obligations with respect to the processing purposes carried out by Marcova.
5. Facebook Ireland Limited will make the essential content of the Site Statistics Annex available to data subjects (Article 26(2) of the RODO) through the data contained in the Site Statistics Information, which can be accessed from all pages.
6. The main supervisory authority for joint data processing is the Irish Data Protection Commission (www.dataprotection.ie).

B. Joint data management with LinkedIn Ireland Unlimited Company
1. Marcova and LinkedIn Ireland Unlimited Company (Wilton Place, Dublin 2, Ireland) are joint controllers of your data in accordance with Article 26 of the DPA for the processing of data for statistical and advertising purposes.
2. Co-administration includes aggregate data analysis for the purpose of displaying LinkedIn page Administrator's user activity statistics.
3. LinkedIn Ireland Unlimited Company's responsibilities:
o To have a legal basis for processing data for page statistics.
o Ensuring that the rights of data subjects are realized.
o Reporting violations to the supervisory authority and notifying affected persons.
o Ensuring appropriate technical and organizational measures to ensure the security of your data.
4. Marcova's responsibilities:
o Having a legal basis for processing data for statistical purposes.
o Fulfillment of information obligations with respect to the processing purposes carried out by Marcova.
5. LinkedIn Ireland Unlimited Company will make the essential content of the Site Statistics Annex available to data subjects (Article 26(2) of the RODO) through the data contained in the Site Statistics Information, which can be accessed from all sites.

Contact forms and email contact with Marcova
Marcova allows on the Services and on its profiles on Social Networks (so-called fanpage) to contact us using electronic contact forms and instant messaging. In order to use the form, you are required to provide personal data necessary to contact you and respond to your inquiry.
Provision of data marked as mandatory is required for effective communication, and failure to provide such data will prevent us from handling your inquiry.
We process this data for the following purposes:
• Identification of the sender and handling of correspondence: For the purposes of identifying you as a sender and handling correspondence, as well as for the investigation and defense of claims and ensuring accountability. Legal basis: legitimate interest of Marcova (Article 6(1)(f) RODO).
• To conduct communications and fulfill the contract: For the purpose of conducting communications with you, as processing data necessary for the performance of a contract, activities aimed at concluding a contract, or to take action at your request before concluding a contract. Legal basis: (Article 6(1)(b) of the DPA). Marketing and commercial information from Marcova
• Direct marketing (when you are our customer): For direct marketing purposes in connection with Marcova's commercial activities, when you have become our customer (e.g. you have created an account on the site, finalized a transaction, subscribed to our newsletter). Legal basis: our legitimate interest (Article 6(1)(f) RODO).
• Direct marketing (when we establish a relationship): For direct marketing purposes in connection with Marcova's commercial activities when we are just establishing a relationship (e.g. you want to buy goods or services without registering on our Service). Legal basis: your consent (Article 6(1)(a) RODO). Important! If we want to provide your data to our Partners so that they can send you marketing communications, we will always ask you first. We do not sell your data to other companies. In addition, you have a choice of communication channel, which is your consent to receive commercial/marketing information/event promotions, etc. to the email address you provide, by phone or SMS. Marcova's data analysis and other purposes
• Analytical and statistical purposes: we process your data for analytical and statistical purposes, conducting analysis of Users' activities and preferences when using our social profiles and websites (including detecting abuse and violation of rules and regulations) and to improve the functionalities used. Legal basis: our legitimate interest (Article 6(1)(f) RODO).
• Archival purposes and system security: We process your data for archival purposes and to maintain the business continuity and security of our IT systems. Legal basis: our legitimate interest (Article 6(1)(f) RODO). In the case of redundant Personal Data that you provide to Marcova that we do not generally need, you provide such data to us on the basis of your consent (Article 6(1)(a) RODO). Your personal data related to the performance of the contract will be retained for 5 calendar years counting from the next year after which the tax obligation occurred. We generally process personal data until the purpose is fulfilled or until you object or withdraw your consent, depending on the legal basis. However, in some cases, we may process data for the statute of limitations for the investigation and defense of claims in accordance with applicable laws. In the case of the Contact Form, we generally process your data for the period of correspondence with you or for the period of performance of actions arising from the subject matter of the correspondence or performance of the contract and actions preceding it. Please note that you will usually realize the issues of deletion of data from social networks directly as a user of such a portal and it is necessary to turn to the operator of such a portal. For more on this topic, see below in the section on the exercise of your rights.
7 What data do we collect about you?
In general, we collect and process ordinary personal data to the extent justified by the above purposes. In particular, Marcova may process the following categories of data, among others:
• Basic identification data: first names, last names, mailing address, business address, tax ID, VAT ID, company name, social network data provided by you.
• Contact data: phone number, email address.
• Your image data: in case of interaction with Marcova via your profile on social networks (e.g. Facebook, LinkedIn) - you voluntarily share your image or avatar, while Marcova generally does not use it. • IP address and Internet identifiers and cookies: source of access to the site, connection time, URL and browser type and version.
8 Who do we share data with?
Recipients of your personal data may only be entities authorized to receive them by law and to the extent necessary to fulfill the given purpose of data processing in accordance with this privacy policy. We share them with:
• To entities providing services to Marcova: for legal, tax, accounting, auditing services; including other Marcova branded companies such as Drivee Ltd.
• Entities performing shipment handling: carriers, freight forwarders, courier brokers, entities handling the warehouse and/or shipping process.
• Entities handling payments: electronic or credit card.
• Providers of feedback survey system.
• Credit providers, lessors: in terms of financing of purchased products.
• Public authorities: based on applicable laws.
• Entities providing technology infrastructure support: hosting, IT support, ICT system providers, Marcova website security and functionality systems, CRM system, email automation (mailing system), Google services (provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) and Microsoft 365 within the office suite (Microsoft Ireland Operations, Ltd. One Microsoft Place, South County Business Park Leopardstown Dublin 18, D18 P521, Ireland).
• Social networks: LinkedIn Ireland Unlimited Company, Facebook Ireland Ltd and others in the use of Internet technology (cookies, mobile IDs, pixels and other Internet tags) and resulting from functionalities provided by these companies, such as Hotjar.
9 Do I have to provide data?
Provision of personal data is a prerequisite for the performance of the contract or pre-contractual actions. If you do not provide personal data, it will not be possible to conclude and execute a contract or take pre-contractual actions, including on social networks or trading platforms. To the extent that personal data is collected by us based on consent, providing personal data is voluntary.
In order to be able to browse the website, Marcova must receive your basic data over the Internet, otherwise visiting the websites would not be possible at all. Providing data is also necessary to send a response to your inquiry or to conduct communications with Marcova.
Remember to update any Personal Data you provide if there are changes in any respect.
10 What are my rights when Marcova processes my data?
Any person whose Personal Data is processed by Marcova Business Ltd. has the right to be informed about the fact and extent of the processing of his/her Personal Data. Our company realizes this right by fulfilling its information obligation.
The scope of the data provided under this information obligation depends on how the personal data was obtained.
In accordance with Articles 13 and 14 of the RODO, we inform you if your personal data was obtained:
• directly from you,
• or from other sources, e.g., from social networks (Facebook, LinkedIn), when you share your data with us via social plug-ins or functions (e.g., Facebook), or from so-called marketplaces, such as Allegro, which, in order to complete a transaction, provide us, as the seller, with your necessary data to perform the contract. According to the General Data Protection Regulation (GDPR), the data subject has the right to full control over his personal data. Below we explain and outline what rights you have and how you can exercise them:
• Right of access to data: You have the right to obtain confirmation from the Administrator as to whether your personal data are being processed, and if so, you have the right to access them and to obtain information about, among other things, the purposes of processing, the categories of data processed, the recipients of the data, the planned duration of data storage. • Right to rectification of data: You have the right to request that the Administrator immediately rectify inaccurate personal data or complete incomplete data. To this end, write to: rodo@marcova.pl
• Right to erasure of data ("right to be forgotten"): You have the right to demand that the Administrator immediately erase your personal data, if one of the prerequisites specified in Article 17 of the RODO applies (e.g., the data are no longer necessary for the purposes for which they were collected, the Person has withdrawn consent for processing and there is no other legal basis for processing). • Right to restrict processing: You have the right to request the restriction of processing in the cases specified in Article 18 RODO (e.g. you question the correctness of the data, the processing is unlawful). To this end, write to: rodo@marcova.pl
• Right to data portability: You have the right to receive in a structured, commonly used machine-readable format the personal data you have provided to the Administrator, and you have the right to send this data to another controller without hindrance from the Administrator. To do so, write to: rodo@marcova.pl
• Right to object: You have the right to object to the processing of your personal data when the processing is carried out on the basis of the Administrator's legitimate interests (Article 6(1)(f) RODO), including profiling. To do so, write to: rodo@marcova.pl
• Right to withdraw consent: If the processing is based on your consent (Article 6(1)(a) RODO), you have the right to withdraw this consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. To do so, write to: rodo@marcova.pl
• Right to lodge a complaint with a supervisory authority: You have the right to lodge a complaint with the President of the Office for Personal Data Protection if you consider that the processing of your personal data violates the provisions of the RODO.
You then file a complaint with the supervisory authority. In Poland, the supervisory authority is the President of the Office for Personal Data Protection. Address: 1A Moniuszki St., 00-014 Warsaw. For more information, see www.uodo.gov.pl.
In the case of social networks and that you have profiles on them, we would like to inform you that in many cases it is these portals that allow you to manage your profile and exercise your rights. Marcova does not have the ability to intervene and, for example, rectify your personal data contained in the portals (you must apply personally to these portals here). With the exception of providing us with your data from a social network using, for example, "Like", "Observe", options to share posts or information, chat, messages, comments through our fanpages, we can only realize certain rights. We also cannot delete your data from the portals (we can, for example, delete a comment or messages sent to us - as long as it does not violate the law or Marcova's legitimate interest, or we have another legal basis and we need to process the data). Exercise of the right to restrict data processing, to our knowledge, is not possible on Facebook or LinkedIn through our actions, as well as the right to data portability (we do not have your data in a form that allows portability from the social network).

11. is my data profiled?
In terms of the operation of our Services, such as traffic analysis and offering, we may perform profiling. This involves assessing what information, products or services you may be interested in, based on the actions you take on the site. We, too, do not like to receive content that does not interest us. The profiling we do does not result in decisions that produce legal effects against you or affect you in a similarly material way. It is intended to help us better tailor our products, services and content on the Services to meet your expectations.
12 Does Marcova transfer my data outside the European Economic Area?
As a general rule, we do not transfer personal data outside the European Economic Area ("EEA"). Given the provision of services by our subcontractors in the implementation of support for ICT services and IT infrastructure, we may outsource certain activities or IT tasks to approved subcontractors operating outside the EEA, which may result in the transfer of data outside the EEA. In accordance with the European Commission's decision, certain countries of recipients outside the EEA provide an adequate degree of protection of personal data in accordance with EEA standards. For recipients outside the EEA and not covered by the European Commission's decision, we enter into agreements with recipients of personal data based on standard contractual clauses issued by the European Commission to ensure an adequate degree of protection. A copy of the standard contractual clauses can be obtained from Marcova, as controller. We apply safeguards to your data in accordance with the principles provided in Chapter V of the RODO.
13 Information about the use of cookies and other identifiers.
We make every effort to ensure that our websites provide as much useful information and are as helpful as possible. To this end, Marcova uses cookies or similar techniques. Below we describe how we use this information and how a Site User can manage consent to the use of cookies.
Cookies are small text files that are stored on your end devices (computer or mobile device - mobile IDs) when you visit certain sites. Our Services may also use other similar techniques, such as tracking pixels, web beacons, digital device tags, including so-called Indexed Storage or Local Storage, etc. For simplicity, all of these techniques will be referred to hereafter as "cookies."
Basically, cookies/mobile identifiers are divided into:
• Persistent cookies/mobile identifiers - remain on the device's web browser until deleted by the user or until a predetermined time by us.
• Session cookies/mobile identifiers - remain in the device's web browser until you turn it off or exit the website where they were placed.
• Third-party cookies/third-party mobile identifiers - are information coming, for example, from advertising servers, servers of companies and service providers (e.g. internal search engine or maps placed on the website) cooperating with the owner of the website. This type of cookie allows to tailor advertisements to the preferences and habits of their Users. They also make it possible to evaluate the effectiveness of advertising activities (e.g. by counting how many people clicked on a given advertisement and went to the advertiser's website). Based on the information obtained from these cookies, it is possible to create so-called general profiles of Users, thanks to which, for example, men who are interested in new technologies (visiting sites on this subject) will see ads tailored to their potential interests, rather than, for example, an ad for women's shoes.
Marcova uses cookies for the following purposes:
• Proper functioning of the site: Without cookies, the site would have difficulty remembering logins or products added to the shopping cart. Such cookies are called required cookies.
• Site usage analysis and improvement: For analyzing site usage, calculating visitor numbers and making improvements. We do not send site usage statistics or other reports to individuals. These types of cookies are called analytical cookies.
• Social media integration: For integrating social media into your site, allowing you to instantly share your site or product on your favorite social networks.
• Creating personalized web ads: Which are of interest to Users. Such cookies are called targeted advertising cookies.
Depending on the website you use, the type and number of cookies and mobile IDs may vary. You can change your cookie management settings in your browsers or by using cookie banners.

Marcova uses technology that allows you to manage such settings when you visit the Site using a special banner.
Server logs
Use of the Services involves sending requests to the server on which our websites are stored. Each request made to the server is recorded in the server logs. The logs include, among other things, your IP address, the date and time of the server, information about your web browser and the operating system you are using. The logs are saved and stored on the server. The data stored in the server logs are not associated with specific individuals using the site and are not used by us to identify you.
Server logs are only auxiliary material for the administration of the site and its security, and we do not disclose them to anyone except those authorized to administer the server. Rules and data collection by social networks/social tools and search engines. We use so-called plug-ins and other social networking tools on our Site. Your browser will then establish a direct connection to the servers of the service providers (i.e. other administrators) of the social networks. The content of the plug-in is transmitted by the respective service provider directly to your browser and is integrated into the site. Thanks to this, the service providers receive information that your browser has displayed our site even if you do not have a profile with the given service provider or are not logged in at the moment. Such information (along with your IP address) is sent by your browser directly to the service provider's server and stored there. If you log in to one of the social networks, this service provider will be able to directly associate your visit to our website with your profile on the respective social network. If you use the respective plug-in, for example, by clicking on the "Share" button, the corresponding information will also be sent directly to server of the respective service provider and stored there. In addition, the information will be published on the respective social network and will appear to people added as your contacts, e.g. on the so-called Wall. The purpose and scope of data collection and their further processing and use by service providers, as well as the possibility of contacting you and your rights in this regard and the possibility to make privacy settings are described in the privacy policies of the individual service providers indicated below.
Analytics and advertising:
Google Analytics automatically collects information about your use of Marcova's websites.
